By accessing this website, booking photography services, submitting forms (including model releases), or otherwise engaging with Gymnastics Sports Connection (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”).
If you do not agree, you should not use our website or services.

2. Services Provided

• Gymnastics Sports Connection provides photography and related media services, including but not limited to:
• Gymnastics event photography
• Sports photography
• Portrait sessions
• Digital image delivery
• Related promotional media services

Specific service details, pricing, and deliverables may be outlined in a separate agreement, invoice, or booking confirmation.

3. Booking, Payment & Cancellations
A. Deposits

• A non-refundable deposit may be required to secure a session or event date.
  

B. Payment

• Full payment terms will be provided at the time of booking. Failure to remit payment may result in cancellation of services or withholding of image delivery.
  

C. Cancellations & Rescheduling

• Cancellations must be submitted in writing.
• Deposits are non-refundable unless otherwise agreed in writing.
• Rescheduling is subject to availability.

4. Minor Participants & Model Releases
For photography sessions involving minors:

• A parent or legal guardian must complete and sign a Minor Model Release prior to participation.
• No photography of minors will proceed without proper authorization.
• The signed release governs the usage rights of images.

Clients represent that they have full legal authority to grant permissions on behalf of any minor participant.

5. Intellectual Property Rights
All photographs, images, digital files, and related content created by Gymnastics Sports Connection remain the exclusive intellectual property of the Company unless otherwise agreed in writing.
Clients are granted a limited, non-transferable license for personal use only unless a separate commercial license agreement is executed.
Personal Use License Permits:

• Printing for personal display
• Sharing on personal social media accounts

Without Written Permission, Clients May Not:

• Sell or license images
• Use images for advertising or commercial purposes
• Edit, alter, or apply filters to images
• Submit images to sponsors or brands

6. Commercial Use
Any commercial, advertising, promotional, sponsorship, or resale use of images requires a separate written agreement and may require additional model releases.

7. Image Delivery & Storage

• Delivery timelines are estimates and not guarantees.
• Final image selection and editing style are at the discretion of the photographer.
• We are not required to retain digital files indefinitely unless otherwise agreed in writing.

Clients are responsible for backing up delivered files upon receipt.

8. Limitation of Liability
To the fullest extent permitted by law:

• Gymnastics Sports Connection shall not be liable for indirect, incidental, or consequential damages.
• In the event of equipment failure, data loss, illness, venue restrictions, weather conditions, or other circumstances beyond our control, liability shall be limited to the total amount paid for services.

We are not responsible for missed images due to:

• Participant lateness
• Lack of cooperation
• Venue limitations
• Third-party interference

9. Assumption of Risk (Event Photography)
Clients acknowledge that gymnastics and sporting events involve inherent physical risks. The Company is not responsible for injuries occurring during events or sessions.

10. Website Use
Users agree not to:

• Attempt unauthorized access to the website
• Upload malicious code
• Reproduce website content without permission

All website content, including text, branding, logos, and images, is protected by applicable intellectual property laws.

11. Privacy
Use of this website and submission of forms is governed by our Privacy Policy, available at:

12. Governing Law
These Terms shall be governed by the laws of the State of Texas.
For services conducted in California, applicable California laws shall apply to activities occurring within California, including privacy and publicity rights.

13. Dispute Resolution
In the event of a dispute:

1. Parties agree to attempt good-faith negotiation.
2. If unresolved, disputes shall be resolved in the state or federal courts located in Texas, unless otherwise required by law.

Each party shall bear its own legal fees unless otherwise required by statute.

14. Indemnification
Clients agree to indemnify and hold harmless Gymnastics Sports Connection from any claims, damages, or liabilities arising from:

• Unauthorized use of images
• Breach of these Terms
• False representations regarding authority to sign model releases

15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

16. Modifications
We reserve the right to update these Terms at any time. Updates will be posted on this page with a revised effective date.
Continued use of the website or services constitutes acceptance of the updated Terms.
